Lesiones en general

A serious injury can upend your health, your job and your family’s routine in a single moment. If someone else’s carelessness caused it, Wisconsin law may let you hold that person, and any liability insurer covering them up to its policy limits, responsible for what you have lost (Wis. Stat. 632.24).

844-SEE-MIKE now has an office in Milwaukee, and our team handles injury claims for people hurt in the city and the surrounding area. We work on a contingency fee, which means you pay no attorney fee unless we recover money for you.

Personal Injury Cases We Handle in Milwaukee

Here is how Wisconsin law approaches each of these cases.

Accidentes de tráfico

Wisconsin requires a liability policy on vehicles driven on its highways, and auto policies generally must include uninsured motorist coverage (Wis. Stat. 344.62 and 632.32). Learn about Milwaukee car accident claims.

Accidentes de camiones

Wisconsin has adopted federal motor carrier safety rules covering driver qualifications, hours of service, and vehicle inspection and maintenance (Wis. Admin. Code Trans 325.02). Learn about Milwaukee truck accident claims.

Accidentes de motocicleta

Wisconsin’s helmet law applies to riders under 18 and riders with an instructional permit (Wis. Stat. 347.485(1)(a)). According to NHTSA, the majority of multi-vehicle motorcycle crashes are generally caused when other drivers simply did not see the motorcyclist. Learn about Milwaukee motorcycle accident claims.

Accidentes de peatones

At an intersection or crosswalk without traffic signals, drivers must yield to a pedestrian crossing within a marked or unmarked crosswalk (Wis. Stat. 346.24(1)). In 2024, 7,080 pedestrians were killed and more than 71,000 were injured in traffic crashes nationwide, according to NHTSA. Learn about Milwaukee pedestrian accident claims.

Accidentes de bicicleta

A driver passing a bicycle must leave a safe distance and in no case less than 3 feet of clearance (Wis. Stat. 346.075(1)). Wisconsin law also bars opening a vehicle door on a highway without first making sure it will not interfere with traffic or endanger anyone (Wis. Stat. 346.94(20)(a)). Learn about Milwaukee bicycle accident claims.

Accidentes de Uber y Lyft

Wisconsin ties rideshare insurance to the driver’s app status, with at least $1,000,000 in liability coverage once the driver has accepted a ride request (Wis. Stat. 440.48(1)(c)1. and 440.40(7)). After a crash, the rideshare company and insurers involved must share the precise times the driver logged on and off the app in the 12 hours before and after the accident (Wis. Stat. 440.48(3)(d)). Learn about Milwaukee Uber and Lyft accident claims.

Mordeduras de perro

Wisconsin makes a dog’s owner liable for the full amount of damages caused by the dog injuring a person, subject to the comparative negligence rule (Wis. Stat. 174.02(1)(a)). You do not have to prove the dog had bitten anyone before. Learn about Milwaukee dog bite claims.

Accidentes por resbalones y caídas

Wisconsin’s safe-place statute requires employers and owners of places of employment and public buildings to construct, repair and maintain them so they are safe for employees and visitors (Wis. Stat. 101.11(1)). In other settings, such as private homes, the owner owes lawful visitors ordinary care under the circumstances. Learn about Milwaukee slip and fall claims.

Lesiones por quemaduras

Burns can result from house and industrial fires, car accidents, and faulty space heaters, furnaces or industrial equipment. When a defective product such as a space heater or battery causes a burn, Wisconsin’s product liability statute can hold the manufacturer responsible (Wis. Stat. 895.047). Learn about Milwaukee burn injury claims.

Lesiones cerebrales

A traumatic brain injury can change memory, mood and the ability to work, and some symptoms may not appear for hours or days after the injury. For injuries on the job, Wisconsin’s workers’ compensation law sets no time limit for claims involving any permanent brain injury (Wis. Stat. 102.17(4)(b)). Learn about Milwaukee brain injury claims.

Lesiones medulares

A spinal cord injury can cause temporary or permanent changes in feeling, movement, strength and body functions below the injury, and treatment may include surgery and rehabilitation. When a spinal cord injury happens at work and causes permanent total disability, Wisconsin workers’ compensation pays weekly benefits for the period the employee may live (Wis. Stat. 102.44(2)(a)1.). Learn about Milwaukee spinal cord injury claims.

Abuso en residencias de ancianos

Wisconsin law gives every nursing home resident the right to be free from mental and physical abuse and to receive adequate and appropriate care within the capacity of the facility (Wis. Stat. 50.09(1)). Unexplained bruises or other injuries, bedsores and changes in mood or behavior can all be signs of abuse or neglect. Learn about Milwaukee nursing home abuse claims.

Abuso sexual

For the childhood sexual assault offenses listed in Wisconsin’s statute, a survivor can bring a civil claim until turning 35 (Wis. Stat. 893.587). We handle these cases confidentially and work to protect your privacy. Learn about Milwaukee sexual abuse claims.

Indemnización por accidente laboral

Workers’ compensation is generally the only remedy against your employer for a job injury, but you may also have a separate claim against a third party, such as a negligent driver (Wis. Stat. 102.03(2) and 102.29(1)). Temporary total disability benefits pay two-thirds of your average weekly earnings, up to a weekly maximum (Wis. Stat. 102.43(1)). Learn about Milwaukee workers’ compensation claims.

Wisconsin Rules That Shape a Milwaukee Injury Claim

Here are Wisconsin rules that can affect an injury claim.

Filing Deadlines

A statute of limitations is the deadline to file a lawsuit. Miss it, and the claim can be barred no matter how strong it is. In Wisconsin, most personal injury lawsuits must be filed within 3 years (Wis. Stat. 893.54(1m)(a)). A wrongful death claim generally has 3 years as well, but a death caused by a motor vehicle accident must be filed within 2 years (Wis. Stat. 893.54(1m)(b) and (2m)).

If the injured person was under 18, the claim can usually be filed up to 2 years after turning 18 when that is later than the normal deadline, with exceptions that include claims against health care providers (Wis. Stat. 893.16).

Shared Fault

Being partly at fault does not automatically end a claim. Under Wisconsin’s comparative negligence rule, you can still recover if your share of fault is not greater than the share of the person you are claiming against, but your compensation is reduced by your percentage of fault (Wis. Stat. 895.045(1)).

Your fault is compared separately against each person found negligent, and a defendant found 51 percent or more at fault can be made to pay the full damages (Wis. Stat. 895.045(1)).

Claims Against a Government Body

Injuries involving a city bus, a police car, a county truck or a public employee follow stricter rules. If a city, county or other local government vehicle or employee was involved, written notice of the claim generally must be served within 120 days (Wis. Stat. 893.80(1d)(a)). Recovery in most of those claims cannot exceed $50,000. For a claim based on the negligent operation of a vehicle owned and operated by a city, county or other municipality, recovery is capped at $250,000. Punitive damages are not allowed (Wis. Stat. 893.80(3) and 345.05(3)).

Claims involving state employees require a sworn written notice served on the attorney general within 120 days, and recovery cannot exceed $250,000 (Wis. Stat. 893.82).

What a Milwaukee Injury Claim May Be Worth

What a claim may be worth depends in part on how fault is divided (Wis. Stat. 895.045(1)) and how much insurance is available (Wis. Stat. 632.24).

When we build a claim, we document the full picture of what the injury has cost you, including:

  • Medical treatment, from the emergency room through rehabilitation
  • Future care your doctors expect you to need
  • Income lost while you recover
  • Reduced ability to earn in the years ahead
  • Pain, emotional distress and the loss of activities you enjoyed
  • Damage to your vehicle or other property

Wisconsin law also sets specific limits for some kinds of damages. In a wrongful death case, damages for loss of society and companionship are capped at $350,000 when the person who died was an adult and $500,000 when the person was a minor (Wis. Stat. 895.04(4)). The family’s representative may also recover reasonable medical and funeral expenses (Wis. Stat. 895.04(5)).

Punitive damages, which punish rather than compensate, may be available when the defendant acted maliciously or in intentional disregard of your rights (Wis. Stat. 895.043(3)). They are generally limited to twice the compensatory damages or $200,000, whichever is greater, but that limit does not apply to a driver who was too intoxicated to drive safely (Wis. Stat. 895.043(6)).

If you were hurt badly enough to need trauma care, you may have been treated at Froedtert. Froedtert Memorial Lutheran Hospital in Milwaukee is listed as a Level I trauma hospital in the Wisconsin Department of Health Services State Trauma Plan. Ask for copies of your records from every provider.
