Children are naturally curious. This curiosity means they are often touching things that can put them in danger for serious burns, including hot liquids and hot foods. Because of their easy accessibility, hot liquids and foods can quickly cause burns that occur in a matter of seconds. When these burns occur due to the negligence of others, those responsible may be found liable for the injuries your child sustained.

If your child has been burned due to hot liquids or food, contact 844 See Mike for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, 844 See Mike is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Hot Liquid & Food Burn Causes

Burns from hot liquids and foods can occur any number of ways. Commonly, children are burned by pulling hot pots and pans from the stove, which is why the American Academy of Pediatrics (AAP) recommends parents and caregivers only use the backburners and turn handles towards the back of the stove when children are in the kitchen. They also recommend that parents refrain from carrying children at the same time as hot pots and that they are aware of where children are when transferring hot liquids from the stove to the table or sink.

Other causes of hot liquid and food burns include:

  • Consumption of overly hot foods and drinks
  • Spilled foods and drinks that are hot
  • Foods or drinks that are overheated in the microwave

If your child has sustained a burn, doctors recommend running cool water over the burn and then seek medical attention as quickly as possible to minimize the damage and complications the burn can cause.

Liability in Hot Liquid & Food Burns

Burns from hot liquids and foods that occur while at restaurants or coffee shops occur frequently and children are often injured when their meal or beverage is not allowed to cool properly. Under section 402A of the Restatement of Torts (Second), the seller of these hot items may be found liable for the damages their negligent actions caused when they breached their duty of care to provide safe products under product liability law.

If a burn from hot liquids and foods occur due to poor supervision of an adult tasked with caring for your child, the caregiver could also be found negligent due to their breach of duty of care. Caregivers are legally required to provide a reasonably safe environment for the children they are in charge of and when they fail, children could be seriously injured by their negligence.

If your child sustained a burn due to hot liquids or food, an experienced personal injury lawyer can review your case and determine who may be liable for their injuries.
