A wrongful death may be determined in a case where the employer acted negligently or intentionally where the result was the death of one of their construction workers. If they fail to establish a certain protocol or instruction for using a particularly dangerous piece of heavy machinery, and consequently a worker is killed while using it, the at-fault party could be determined to be the employer since they acted negligently in not providing the worker with the proper safety.
