All children love to play on a playground, whether that be at school, at a park, or on private property. Spending time on the swings, monkey bars, and slides is fun until an accident occurs. Over 200,000 children under the age of 14 are injured in playground accidents and sent to emergency rooms yearly with serious, sometimes deadly injuries.

Playground Injury Statistics
The Consumer Product Safety Commission (CPSC) has released studies regarding playground safety and playground injury statistics. According to the CPSC, children between the ages of five (5) and nine (9) are at the highest risk of injury on playgrounds, which include fractures, lacerations, contusions, strangulation, and falls.
Approximately three-quarters of playground injuries occur in public spaces, with only one-quarter of playground injuries occurring at home. Of all the playground equipment commonly played on, the CPSC names climbing equipment the most dangerous.
Playground Safety Tips
The American Academy of Pediatrics (AAP) makes recommendations to parents to keep their children safe and prevent playground injuries. These recommendations include:
- Only allow children on playground equipment that is the appropriate size for your child.
- Check the heat of playground equipment, especially slides which can get extremely hot and burn a child.
- Keep children off of swings that are placed too closely together or too close to stationary things such as buildings or trees.
- Remove any drawstrings on clothing that could get entangled on playground equipment.
- Avoid using any playground equipment that is erected on hard pads, concrete, or brick.
Legal Liability in Playground Injuries
Playgrounds are typically owned, maintained, and managed by governmental entities, such as states or townships, as well as daycare facilities, private schools, or other private businesses.
Playground injuries normally fall under the law of negligence regardless as to who owns and/or maintains them. Whether the playground is privately or publicly owned by an individual or corporation, the owner owes a duty of care to those who use their playground to keep them safe and free from injuries. This includes keeping playground equipment maintained and the grounds free from dangers.
There are occasions when playground equipment is defective in its design, manufacture, and/or the equipment does not have the proper warnings or instructions present. If defective playground equipment caused a child’s injuries, anyone in the chain of manufacture of that equipment could be found liable for those injuries under product liability laws.
If your child was injured on playground equipment and you are unsure who is liable for their injuries, an experienced personal injury lawyer can review your case and help you and your child to receive the compensation they may be entitled to.
