For instance, if someone is texting and driving and hits a pedestrian at a crosswalk who later died from complications of the accident, they can be sued for wrongful death. The driver was negligent in not exercising enough care and caution while on the road and by a crosswalk, which resulted in her death. Drivers should always be focused and aware of their surroundings so that they do not hurt anyone around them. Thus, the driver may be found guilty of wrongful death with the help of the attorney of the pedestrian’s family.
Some other less common wrongful death cases include:
- Aviation accidents, where a pilot causes a plane to go down, resulting in possibly hundreds of deaths. Depending on the reason for the plane’s crash in relation to the pilot or airplane manufacturer, this can be a massive wrongful death case.
- Defective products, where the use of the product resulted in death or an injury leading to death. The manufacturers can be found guilty for causing the customer’s death due to their negligence in making the product.
- Workplace accidents, where an employee is tasked to do something that is reasonably dangerous and dies later from what they did. The employer can be sued for wrongful death for putting the employee or allowing the employee to be in that situation. This is more typical of manual labor or generally risky jobs with poor working conditions.
- Fires, where someone can be found culpable for starting a fire that consequently killed one or more people. Whoever started the fire may have started it negligently if it ended up killing others, so they can be found guilty in a wrongful death case.
