May I Rent a Car?

Following the Illinois insurance regulation, an at-fault driver’s insurer is mandated to reimburse you for your car rental expenses proportionate to their liability. However, the insurer may only offer reimbursement covering the typical period it’ll take to repair your vehicle or until they offer you a settlement.

The said regulation does not specify the type of vehicle required, so if your vehicle was a specialty car, the insurer isn’t required to rent a similar model. Normally, rental reimbursement will have a daily rental limit and if you choose a more expensive vehicle, you’ll have to pay the difference out of pocket.
