If you’ve been injured in a slip-and-fall accident in a public walkway, the insurance company will do what it can to cast doubt on your claim and avoid awarding you compensation, and for this reason, documentation can be crucial to your success.

Photographs – The value of photographs following an accident cannot be overstated. If your fall was caused by a poorly-maintained sidewalk, you are obligated to take pictures to use as evidence and to corroborate statements from you and witnesses.

Location – Proving exactly where the accident occurred is very important for these injury claims. For example, you would need the address of a public building if your slip-and-fall occurred outside of it, or the name of the street which contains the walkway.

Witnesses – If anyone witnessed your accident, it may be beneficial to obtain their contact information for future reference.

Surrounding activities – Some public slip-and-falls are caused at least in part by nearby activities, such as construction work. Take note of any such activity going on around you at the time of the accident which may be relevant to your case.

Wait for an ambulance if you are safely able to do so. Driving or walking to the hospital by yourself will make excellent ammunition for the insurance company to discredit your claim and argue that your injuries were exaggerated, and this can be especially detrimental to your case due to the lack of an ambulance report. If you do wait even one day to seek medical attention, it will not necessarily nullify your case but will bring it under intense scrutiny and may make it more difficult to win.
