Causes of Chemical Burns

Chemical burns most commonly occur in the home or other childcare facility and are often due to poor supervision or defective chemical packaging. Because containers can explode, parents are urged to store all chemicals at proper temperatures and ensure that they are kept far from the reach of children.

Some of the most common types of chemicals that can cause chemical burns include:

According to the American Burn Association, chemical burns account for 3% of all burn center admissions. Children may spill these chemicals on the skin, get them into their eyes, or even attempt to swallow these toxic substances, and all chemical burns should be treated immediately. Some chemical exposure will not immediately be visible or cause immediate pain, but all chemicals have the potential to cause extensive damage over time, including blindness, scarring, disfigurement, infections, and death. 

Liability for Chemical Burns

Chemical burns can be caused by negligent supervision, intentional child abuse, or a defective product. Depending on the circumstances of your child’s chemical burn, more than one entity could be held liable for their injuries.

If a child is burned due to a defective product, the product manufacturer and anyone in the chain of distribution of that product could be held liable for your child’s injuries under a product liability claim. Chemical product liability claims typically involve defective packaging, when a child was easily able to open a chemical container, or failure to warn, when a product manufacturer fails to properly provide consumers with warnings as to the danger of their product or instructions on how to use or store the product safely.

If a child’s caretaker allows access to dangerous chemicals, the caretaker could be held liable for the injuries their negligent behavior caused. Also, if a child was injured while at daycare or school while under the care of a teacher, the facility may be found liable under the theory of vicarious liability. If the employer was negligent in its hiring or training practices for its employees, the employer could also be found directly liable if a child is injured under their care.
