Car seats for children are required in every state. In Illinois, as in many other states, this includes car booster seats for children under the age of eight (8). Every year, over four (4) million car seats are sold within the U.S. and while car seats have saved countless infants and children from serious injuries and death in a car accident, some have actually been the cause of injuries and death due to poor design, defective manufacturing, or improper usage.

If your child has been injured in an accident, contact 844 See Mike for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, 844 See Mike is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Causes of Car Seat Injuries

Car accidents are the top cause of death for children between the ages of five (5) and eight (8). Because of this, the National Highway Traffic Safety Administration (NHTSA) has recommended car seats as a method of protection for all children aged eight (8) and under. Unfortunately, when these safety devices are defective, they can cause devastating injuries.

Some of the most common car seat defects include:

  • Weak frames or cushions that come loose
  • Faulty latches that unclip under minor force
  • Latches that are difficult to unclip in the event of an emergency
  • Low quality straps that fray, tear, or are flammable
  • Strap adjusters that do not allow straps to be snug or leave straps too tight

When a car seat or its components are defective, it can turn minor car accidents into a catastrophe.

Car Seat Injury Liability

If a child suffers injuries due to a defective car seat, a product liability case may be brought against anyone in the chain of distribution of the car seat, including the product designer, assembler, manufacturer, and distributor of the product. Damages may be awarded for medical bills associated with the injuries sustained, as well as continuing medical treatments that your child may require. Your child may also be awarded compensation for pain and suffering, rehabilitation and therapy, disability, disfigurement, and punitive damages, depending on the specifics of their accident.

In some cases, car seat injuries occur due to the negligence of adults tasked with properly installing the car seat. According to the NHTSA, three out of four adults improperly use or install car seats in their vehicle, yet over 95% of adults believe they are using car seats or restraint properly.

If a caregiver, babysitter, family member, nanny, or family friend was negligent in their use of a car seat, or they failed to properly restrain your child while in a vehicle and an accident occurred where your child was injured, you may be able to collect compensation for their injuries.

Watching your child suffer following an accident is heartbreaking, especially when you believed you were providing them with the proper protection to keep them safe. If your child was injured in an accident and you believe a defective car seat or the negligence of another person caused their injuries, consider a free consultation with one of our lawyers to review your case.
