Bleachers are just a way of life for those that enjoy watching sports. While those uncomfortable metal structures are the best way to provide seating to the masses, they are not always safe, especially for young children. When bleachers are improperly designed, improperly maintained, not outfitted with proper safety features, or users are not warned of the dangers that bleachers can pose, serious injuries can occur.

Causes of Bleacher Falls

Schools, stadiums, and other businesses with bleachers often fail to protect their visitors by utilizing unsafe or defective seating. According to the Consumer Product Safety Commission (CPSC), approximately 15,000 children under the age of 15 are injured in bleacher falls every year, even with recommended guidelines set up by the CPSC.

The most common causes of these bleacher accidents include:

  • Poor supervision or lack of rules
  • Lack of warning signs
  • Poor maintenance
  • Poorly secured bleachers
  • Lack of aisles
  • Slick surfaces
  • Gaps in the footboards
  • Lack of, or poorly secured, guardrails
  • Lack of handrails

Bleacher falls can also be due to defective design, improper assembly, improper maintenance, or a combination of causes, often resulting in devastating injuries.

Liability in Bleacher Falls

Determining who may be liable for the injuries your child sustained in a bleacher fall can be difficult. The experienced personal injury lawyers at 844 See Mike can review your case and help determine who may be at-fault for the damages your child suffered.

Generally, liability in bleacher falls can fall under negligence actions or product liability actions.

 Negligence

Negligence can be attributed to a number of different parties, including the management company, property owner, and the assembler or equipment installer. Each party has a duty of care to provide bleachers that are safe and meet all minimum code requirements. Property owners are also required to ensure that the bleachers are kept clean, free of debris, and are otherwise in reasonably safe conditions for those that are using the bleachers. When any of these parties are negligent in their duty, they could be found liable for the injuries your child sustained.

Product Liability

If it can be shown that a defect in the bleachers or any of its parts was the cause of your child’s injuries, the manufacturer or anyone else involved in the chain of distribution of could be held liable under product liability. Design defects, manufacturing defects, and failure to warn defects can all contribute to bleacher fall accidents and serious injuries to a child.
