Winter weather is here, and there are some things you should know about “slip-and-fall” accidents caused by ice, rain, and snow.

These personal injury cases arise when an individual is injured by slipping and falling on another person’s property, and the owner of the property may be held legally accountable for the victim’s injury. Although these cases generally involve slippery floors, leaky ceilings, and the like, they also arise due to the precipitation of the winter months and the slippery surfaces it creates.

In Illinois, such injury claims require proof that an “unnatural accumulation” of ice or snow caused the injury in question. Although the line between natural and unnatural accumulation can be rather blurry, there are a few deciding factors for each. Two which are considered “natural” accumulation are ice formed by packed-down snow by pedestrians and traffic, and puddles of water inside buildings which formed from snow tracked-in from outside. Examples of “unnatural” accumulation generally consist of property defects which cause ice and/or snow to accumulate in particular locations, such as downspouts that pour water (which freezes into ice) onto sidewalks, and various actions by property owners which produce the same results.

In these claims, insurance adjusters almost always assume the “no liability” stance, in turn provoking claimants to sue, and this is why it is essential to speak with an experienced personal injury attorney who will handle your case and ensure just compensation.
