Truck accidents can be catastrophic. These are the accidents that receive the most coverage, where injuries were suffered, or fatalities occurred. Fortunately, some truck accidents are not this extreme and involve property damage only. Property damage is basically any damage that does not involve a human and can include the vehicle and anything being carried within it, as well as the surrounding area, like a fence, trees, or a home.

Property damage truck accident claims are no less frustrating, however. If you or a loved one has been involved in a truck accident due to another driver’s negligence, our experienced personal injury attorneys are here for you every step of the way to ensure that your rights are protected, and you are fully compensated for your injuries and losses.

Filing a Property Damage Claim

Following any truck accident, the most important step is to make sure everyone is ok. You will also want to call the police as the insurance company will want a police report for your claim

Exchange information with the other driver, including if he or she is an independent contractor or works for a trucking company or governmental entity as they may be held liable for damages as well, and make sure to get the names and contact information for any witnesses.

Take pictures of both vehicles and anything at the accident scene that may be important for your claim.

You will need to contact your insurance company immediately following any accident. They will review with you what happened and inform you of the steps you should take. Within a few days, a claims representative will contact you regarding your claim.

Claims representatives work for the insurance company. It is their job to get as much information as they can from you, and to get an official statement.

Please remember: All communication with an insurance claims representative may be recorded.

Answer all questions honestly, thoroughly, and without exaggeration. If a question is confusing, ask for clarification and if you do not know the answer, say so. Avoid answering every question as an “I don’t know”, however, as this makes it appear that you are hiding something.

After discussing the accident with you, the claims representative will schedule a claims adjuster to inspect your car. Insurance companies are notorious for writing up low estimates and if the cost of repair is more than the Kelly Blue Book value of your car, the insurance company will consider it “totaled” and you will be issued a check.

Insurance adjusters are professionals at making the claims process difficult, frustrating, and intimidating. It is their job to make claims payouts for as little money as possible. It is important to remember:

  • All communication will be recorded
  •  The initial offer is just that, an initial offer that you do not need to accept
  • You have the right to a rental vehicle or reimbursement for one
  • You do not need to use the repair shop that the insurance company chooses, but it may be easier
  • You have a statute of limitations and insurance companies know this, often dragging out negotiations

Insurance companies are difficult to deal with. If you, or a loved one, has questions regarding a truck accident or property damage claim, contact an experienced property damage truck accident lawyer.
