Do pedestrians always have the right of way?

Not always. While pedestrians usually have the right-of-way and are offered certain legal protections against vehicles and bicyclists, this does not mean that the pedestrian has the right-of-way in every circumstance.

Pedestrians’ rights and duties under Illinois law are covered in Article X of Chapter 11 of the Illinois Vehicle Code, and there are indeed some circumstances in which they do not have the right-of-way. At crosswalks, for example, pedestrians cannot simply walk into them whenever they want: the law says they shall not “suddenly leave a curb or other place of safety and walk or run into the path of a moving vehicle.” Pedestrians must always exercise proper caution to avoid causing an accident with a moving vehicle, or legal liability may fall on the pedestrian for his/her negligence and the damages it may have caused.
