Defective Infant Sleepers – Child Injuries & Accidents
When you purchase a product, especially one that is specifically designed for infants and children, you assume that it has met the stringent testing required to keep your child safe. Unfortunately, some child-product manufacturers will attempt to cut corners when testing their products. This lack of care can not only result in defective products, but also serious, sometimes deadly infant injuries.
If your child has been injured by a defective infant sleeper, contact 844 See Mike for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, 844 See Mike is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.
Safe Infant Sleeping
According to the American Academy of Pediatrics (AAP), the safest way for an infant to sleep is on a flat, firm surface, on their backs, with no bedding or bumpers in place. Experts have urged federal safety officials to review the safety of inclined infant sleepers because they do not meet the requirements set forth by the AAP.
Inclined sleepers prop infants up at an angle, which the AAP states makes it more difficult for an infant to breathe. In fact, Canadian law bans any sleeper that places an infant at an angle greater than 7-degrees, while U.S. law allows infant sleepers to be between a 10 and 30-degree angle.
The Consumer Product Safety Commission (CPSC) reports that the over 700 deaths due to infant sleepers were caused by strangulation and suffocation due to the infants inability to reposition their own head when it falls forward, falls on unsteady or uneven surfaces, and falls out of the sleeper when proper restraints weren’t used.
Wrongful Death
Since 2008, millions of infant sleepers have been recalled by the CPSC due to the danger they pose to children. In 2019, Fisher-Price’s Rock ‘n Play Sleeper was recalled for over 50 infant deaths after an initial 2013 recall due to mold issues on the same product. Twenty-six other companies have also had infant sleepers recalled for a variety of safety issues in the U.S.
When a child tragically dies due to an infant sleeper, parents have the right to pursue compensation for their loss in a wrongful death case against the product manufacturer, distributor, and anyone else in the chain of distribution for the defective product. An experienced personal injury lawyer can review your case and determine who may be liable for your losses and what compensation you may be entitled to.
