Wrongful Death From Maritime Accidents
A maritime accident is any type of accident that occurs aboard a sea vessel, or out at sea. The maritime industry is essentially an industry of occupations and careers that are all on the sea, such as those working for the United States Navy or Marine Corps. An accident at sea can be disastrous due to the surrounding conditions, and even more unfortunate if it could have been prevented, had someone been more careful. When a wrongful death occurs as a result of a maritime accident, someone should be held accountable for such a tragedy.
Losing a loved one is painful as it is. The added devastation of knowing that they were away at sea, doing their work, and you suspect that it could have been prevented is a lot to process all at once. Wrongful death from a maritime accident could be any number of unique accidents, given it is a much different setting from our everyday lives:
- A slip-and-fall somewhere on the deck caused by seawater on the floors.
- Dock and pier accidents. An injury can be sustained from completing tasks at a dock or pier. This can include heavy lifting, slipping, vehicles hitting workers on the docks, etc.
- Falling overboard. This can occur from any number of things, including fishing or switching from one boat to another.
- Enclosed spaces. This is common out at sea, where space must be used wisely and conserved for efficiency. But, it can actually heighten your risk of panic attacks, suffocation, and exposure to toxic fumes.
There are many more possibilities of how people may lose their life after a maritime accident. Any close family members may sue for wrongful death on behalf of the deceased. In any case, the family member that initiated the case should be able to prove that it was, in fact, a wrongful death with the help of their attorney. A wrongful death is qualified by proof of a negligent or intentional act by the person that caused their loved one’s death.
Negligence can be seen through poor training by the staff resulting in incorrectly completing a risky task. Or, if the cleaning and hygienic procedures were not up to the proper standard, toxic fumes or water can hurt people in various ways.
