Trucking Accidents and Intoxication
Thousands of professional truck drivers are on our roads each day, and while most are responsible and committed to upholding strict safety standards, drug/alcohol use is a primary factor in a significant percentage of accidents involving large trucks each year. If you’ve been injured in an accident with a truck due to negligence, speak with an experienced personal injury attorney as soon as possible.
According to the most recent report from the Federal Motor Carrier Safety Administration (FMCSA) with data leading up to 2015:
– The “raw number” of intoxicated truck drivers who were involved in fatal accidents increased from 2014 to 2015; – The number of fatal accidents involving buses or large trucks increased by 5% from 2014 to 2015; – Accidents involving buses or large trucks which resulted in injuries increased by 62% from 2009 to 2015. Some are calling for improvements to federal drug/alcohol testing guidelines for professional truck drivers. Current regulations by the FMCSA and Department of Transportation (DOT) include: – Any driver who owns a commercial driver’s license (CDL) and operates a commercial vehicle on public roads, whether part-time, full-time, intermittent, or international, is subject to drug/alcohol testing by the Department of Transportation. – DOT guidelines mandate laboratory testing for six types of drugs, as well as “cutoff concentrations” of drugs and blood-alcohol concentrations exceeding .02. – Drug testing is required prior to employment, following a serious accident, upon suspicion of intoxication, and randomly throughout the year. A driver who fails a test is subject to further testing upon returning to work and follow-up testing for anywhere from twelve months to five years.
