Pedestrians are at a disadvantage in any accident, but when that accident involves a large truck, the results are often catastrophic. In the latest data released by the National Highway Traffic Safety Administration (NHTSA), in 2016 there were 4,317 people killed in crashes involving large trucks, 468 of these deaths involved pedestrians or bicyclists, the highest number of fatalities in 10 years.

If you or a loved one has been injured in an accident due to another driver’s negligence, we at 844 See Mike are here for you every step of the way to ensure that your rights are protected, and you are fully compensated for your injuries and losses.

Causes of Pedestrian Truck Accidents

Throughout the cities of Illinois and on the rural roadways, pedestrians are as common as the large trucks that put them at risk for injury or death. Due to their design, these trucks have multiple blind spots that make seeing pedestrians, who are much smaller than a vehicle, quite difficult.

One of the most dangerous places for a pedestrian to encounter a large truck is at an intersection. Truck drivers making a right turn are often not able to see a pedestrian that is attempting to cross the street and even if they are not directly in the path of a turning truck, pedestrians may be suddenly confronted with the side of a truck making a wide turn.

Commercial trucks are equipped with large mirrors and backup cameras to aid in reversing safely. However, these mirrors and cameras are not always enough. Backing-up accidents can cause severe injury when a pedestrian is pinned and crushed, and the human body is no match for a truck that can weigh up to 80,000 pounds.

Determining Fault in a Pedestrian Truck Accident

Truck drivers have a responsibility to drive safely and failure to do so is considered negligence. However, pedestrians have a duty of care as well, and according to the law, they are to take reasonable responsibility for their own safety. Following a pedestrian truck accident, it may be determined that the pedestrian had contributory negligence if they failed to protect themselves.

Common factors that are considered negligent behavior by a pedestrian include:

  • Ignoring the “walk” signal;
  • Crossing into moving traffic;
  • Failure to use clearly marked crosswalks or following the lights indicating that it is safe to cross.

If you or a loved one was hit by a truck while walking, it is important to contact a personal injury lawyer to review your case to determine who was at-fault and ensure you receive the compensation you deserve.
