Causes of Strangulation

Strangulation hazards can be anywhere, especially for children under the age of three (3). The Consumer Product Safety Commission (CPSC) warns parents of the dangers of posed by window blind cords, necklaces, drawstrings on clothing, swing sets, ribbons, crib bumpers, and toy cords and urges parents to take precautions with these items in the household. 

The biggest risk to children, however, is window blind cords and cribs, toys, and furniture that is placed too closely to this danger. Children will play with anything they can get their hands on and when a cord gets tangled around a child’s neck, the results are often deadly. 

Between 2012 and 2017, the CPSC reported 50 fatalities due to window blind cords prompting window blind manufacturers to adopt voluntary standards in 2018 which puts window coverings into the retail market that do not have dangerous cords.

Liability in Strangulation Incidents 

When your child is under the care of another person, such as a babysitter, nanny, or other caregiver, they are legally required to provide a reasonable standard of care to that child. Window blind cords, other rope-like items, and any other hazard should be kept away from children and they should be completely supervised to prevent any accident from occurring. When a caregiver fails in this duty and your child is injured, they may be found legally liable for your child’s damages.

Product manufacturers have a duty to provide safe products to consumers. When a product is defective and causes injuries to a child, anyone in the chain of distribution could be held liable for those injuries.

Strangulation injuries are often catastrophic. Asphyxiation may cause brain damage and permanent disability.
