In today’s world, we often think of school shootings as a major cause of school injuries, however these tragedies actually only account for a small percentage of school injuries. School Injury Liability

Laws applying to schools differ by the type of school that your child was injured in. Public schools, as government institutions, are typically granted sovereign immunity from certain types of liability as they are funded by tax-payer dollars, which would be at-stake in a lawsuit. Cases against public schools are also held in the Court of Claims, where a special group of judges will hear the case against the government and you only have one (1) year from the date of your child’s injury to file a claim, or your case will be dismissed.

Lawsuits against public schools in Illinois can be an uphill battle, and generally a plaintiff must prove that the school district or its employees were acting recklessly during school-related activities. Examples of reckless actions include:

  • A coach that does not get a student athlete medical attention.
  • A teacher that does not provide proper safety measures for a classroom activity.
  • A gym teacher that forces a student to participate in class even with a doctor’s note that it isn’t safe.

Educators and school districts are often immune from liability caused by ordinary negligence, although there are exceptions. Private schools do not have the same immunity laws that public schools are granted unless the school receives federal funding.
