From time to time we discuss some important and immediate steps to take if you’ve been involved in an auto accident due to another driver’s negligence, as these accidents can vary greatly and occur in a range of situations with unfortunately wide-ranging results. Always remember that evidence is the key to proving negligence in a personal injury claim and earning full compensation for your injuries and losses, and your attorney will be there with you every step of the way.

Preparation can make a huge difference when information should be gathered or recorded as quickly as possible:

  • Keep all information regarding your vehicle, auto insurance, and medical needs or limitations (if necessary) in an accessible part of the vehicle and preferably clipped together or in a binder.
  • Keeping a pen and pad of paper in your glove compartment or another convenient place is extremely helpful, and a charger for your cell phone and even a cheap, disposable mobile phone are also good to keep in the car.
  • Always be sure you have the proper levels of auto insurance coverage that are best for you.

In the unfortunate event of an auto accident, these are your immediate steps:

  • Stop – Any and all motor vehicle drivers are required by law to stop immediately at the scene of the accident if: there was damage to vehicles or other property; and/or if a person was injured or killed. If your car can still be moved, park as close as possible to the accident without interfering with surrounding traffic and turn on your hazard/emergency lights if they work.
  • Assess – Check yourself, your passengers, and the other vehicles’ occupants for injuries to determine if emergency medical attention is necessary.
  • Call law enforcement – You should always notify local law enforcement when an accident occurs, even a minor one, and of course dialing 911 is immediately necessary for serious accidents. Inform them of the location of the accident and your vehicle (the nearest address or intersection helps) and your name. If the accident is considered too minor for police to arrive on the scene, law enforcement may request the details and your driver’s license number and registration over the phone.
