Scald Burns
Scald burns are burns that are fairly common, and are caused by steam, hot liquids, or hot foods. While they range in severity, scald burns can cause more damage than many other types of burns, take longer to heal, and can cause permanent scarring. The most severe cases, scald burns can even be fatal.
Approximately 65% of children hospitalized for burns have received scald burns and a vast majority of those are due to the negligence of another person or a defective product, while some can be attributed to intentional child abuse.
How Scald Burns Occur
Adults are supposed to care for and protect children. However, there are occasions when an adult who is supervising a child is negligent in this care. Babysitters, day care workers, or even family friends can leave hot pots on the stove that get pulled down, give food or drinks that are much too hot, or allow children to play in water that is hotter than the Consumer Product Safety Commission’s (CPSC) recommended level of 120 degrees Fahrenheit or below. When those in charge of a child fail to take reasonable precautions to prevent a scald burn, they are considered in breach of duty of reasonable care, thus liable for the child’s injuries.
An adult that intentionally injures a child may not only be found liable in a civil court, but a criminal court as well. A child that is injured by scald burns due to the intentional actions of another person or their negligence may be entitled to compensation for medical expenses related to the incident, as well as future medical expenses, pain and suffering, disfigurement and disability, and emotional distress.
Child scald burns have also been known to be caused by defective products. For example, if a burn was caused by excessively hot water, the caregiver may not only be found liable, but the manufacturer of the hot water heater and anyone in the line of distribution could be liable as well if it can be shown that the product was defective.
