New Device Could Help Police Catch Distracted Drivers
There is a new, first-of-its-kind device which could allow a police officer to “check a motorist’s cell phone for evidence of distracted driving prior to an auto accident,” and the state of New York is considering deploying it for use by its officers. The device is developed by the same company which helped the FBI to access (“crack”) the iPhone of the San Bernardino shooter in the aftermath of the tragedy.
The legislation is supported by a non-profit organization founded by Ben Lieberman, who said “I have often heard there is no such thing as a Breathalyzer for distracted driving – so we created one. Respecting drivers’ personal privacy, however, is also important, and we are taking meticulous steps to not violate those rights.” If enacted, the bill could serve as what’s called “model legislation” for other states, and motorists who refuse the check for distracted driving may risk losing their licenses due to “implied consent” just like those who refuse Breathalyzers for possible drunk driving; probable cause may be established “based on inference of likely usage.”
The Huffington Post estimates that more than 10,000 fatalities per year are caused by drunk driving, and although these are decreasing slightly, deaths due to distracted driving are unfortunately on the rise and not far behind. While personal liberty must always be protected and future laws pertaining to these devices may vary greatly by state, they do offer great promise for “proving” distracted driving in a way similar to how we identify and prove intoxicated driving as it occurs.
