In today’s busy world, economic demands often require parents to be away from their children during the work week, which often necessitates the services of a nanny. Parents put an enormous amount of trust into these professionals to ensure that their children are well cared for, their needs are met, and they are kept safe. Unfortunately, accidents happen and some of these accidents are due to the negligence of the nanny tasked with caring for your child.

If your child has been injured in an accident, contact 844 See Mike for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, 844 See Mike is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Nanny Neglect and Recklessness

In most cases, an accident would happen to a child, whether their parents were present or not. However, some accidents and injuries occur because a nanny did not fulfill their obligations to your child, or they behaved in a reckless manner that caused your child’s accident.

Some of the common ways a nanny may injure a child may include:

  • Failing to administer medications
  • Failing to follow special dietary restrictions
  • Inviting guests over without permission
  • Failing to provide adequate supervision
  • Failing to protect a child from threats in their surroundings
  • Allowing a child to engage in risky behaviors

If your child was injured under the care of a nanny, you may be within your rights to pursue a claim for compensation for the losses your child has suffered.

Nanny Negligence

To prove that a nanny was negligent in the care of your child, you, as the plaintiff, are tasked with the burden of proof. This means you must prove four key elements that the courts have determined as a standard for negligence in personal injury cases.

These elements in negligence cases are as follows:

  • Duty of care-The plaintiff must show that the defendant (nanny) owed your child a duty of care by accepting responsibility for your child.
  • Breach of duty of care-The plaintiff must show that the defendant breached their duties by either action or inaction.
  • Causation-The plaintiff must show that the actions (or inactions) of the defendant caused your child’s injuries.
  • Damages-Finally, a plaintiff must show that their child suffered actual damages due to the breach of duty of care by the defendant, which can be financial, emotional, or physical.

Determining if negligence occurred due to the actions of a nanny can be subjective. But, an experienced personal injury lawyer can review your case and help determine if a nanny may be responsible for the damages your child suffered while under their care.
