My child has been injured on a trampoline. Is the property owner responsible?
With more than one (1) million trampolines in backyards across the U.S., it is easy to see why trampoline injuries have increased in the past decade. Children under the age of 15 suffer the most injuries which can be attributed to the following:
- Lack of supervision or proper instruction
- Allowing children under the age of six (6) onto a trampoline
- Falling from the trampoline
- Missing safety devices
- Poor maintenance
- Improper assembly
- Too many people using the trampoline at once
In a study published by the National Center for Biotechnology Information (NCBI), 66% of trampoline accidents occur at home as opposed to trampoline parks. There are three main ways a homeowner could be found negligent in regard to a trampoline. First, if a homeowner does not provide adequate supervision, such as allowing too many children to jump on the trampoline at once, or they allow young children to use the trampoline unattended, they could be held liable for injuries that their negligence caused.
Secondly, if a homeowner does not provide the proper maintenance to a trampoline, does not assemble the trampoline properly, or places the trampoline in an unsafe area, they could be held liable. Finally, under the “Attractive Nuisance” Doctrine, if a homeowner failed to take reasonable precautions, like installing a fence to keep neighborhood children from using the trampoline without permission and unsupervised, it could be determined that the homeowner acted negligently, thus they would be responsible for any damages that were sustained.
When a homeowner’s negligence is responsible for your child’s injuries, you, as the legal guardian of your child, can file a claim against the homeowner’s insurance policy or you have the option of filing a lawsuit against the homeowner for the economic and non-economic damages your child sustained. Some of the damages you and your child may be entitled to include:
- Medical bills, both current and on-going
- Lost wages
- Pain and suffering
- Emotional distress
- Loss of enjoyment of normal life
- Disfigurement and/or disability
- Wrongful death
