Car and truck accidents are complicated enough even with clear-cut liability. When the accident involves a government vehicle such as a mail truck, things get even more difficult. Cases involving the USPS are complex and require the expertise of an experienced personal injury lawyer to ensure you receive the compensation you deserve.

If you or a loved one has been injured in an accident due to another driver’s negligence, we at 844 See Mike are here for you every step of the way to ensure that your rights are protected, and you are fully compensated for your injuries and losses.

Causes of Mail Truck Accidents

There are over 200,000 USPS vehicles on the road including large trucks, delivery vans, and mail trucks. These vehicles are not insured like personal vehicles or privately-owned delivery company vehicles, such as UPS or FedEx. Because drivers of mail trucks are government employees, they do not carry private insurance and are protected from lawsuits due to Sovereign Immunity, a doctrine that protects state or Federal entity. However, just because these drivers are protected, it doesn’t mean accidents don’t happen.

Mail truck drivers are just like any other driver and can suffer the same issues as a driver of a passenger vehicle or large truck. The most common causes of mail truck accidents include:

  • Speeding
  • Reckless driving
  • Fatigue
  • Driving under the influence
  • Distracted driving

Mail carriers also different from other vehicles in that they can driver under the speed limit, make irregular stops, drive along the roadway shoulders or the wrong side of the road, and block traffic from flowing safely and smoothly. This inconsistent stop-and-go process can change traffic patterns and confuse other drivers, causing accidents that can be severe.

Another common cause of mail truck accidents is wrong-side driving. In rural areas, mail carriers often drive their own vehicles and are not provided with a mail truck with the pedals and steering wheel on the right-side. This means that some mail carriers will attempt to drive from the passenger side while reaching over to steer and use the pedals on the driver’s side. This is not only difficult it is extremely dangerous as the driver cannot control their vehicle safely and their reaction time is significantly decreased.

Finally, improperly loaded cargo is another common cause of mail truck accidents. If the mail and packages that the mail carrier delivers was not properly secured, was not loaded safely, or the mail truck doors are not properly secured following loading, it is possible for cargo to fall from the mail truck and cause accidents.

Federal Tort Claims Act (FTCA)

If you or a loved one has been injured by a mail truck, a claim must be filed in Federal court under the Federal Tort Claims Act immediately following the accident. The FTCA states that you were injured by a government vehicle due to a federal employee’s negligence and you wish to have compensation for your damages. An experienced lawyer should be consulted to ensure that the claim is written and filed properly within the statute of limitations.

To successfully receive compensation under the FTCA, you will need to prove four key facts which include:

  • Your damages and/or injuries were caused by a federal government employee;
  • The employee was working at the time;
  • The employee acted negligently;
  • The employee’s negligent act led to your damages.

Once the initial claim is filed, a response will be sent regarding the Federal government’s decision. If the government denies your claim, you then have six months to contest the decision and file a lawsuit for your damages.

Dealing with a governmental entity is not easy. But, the experienced lawyers at 844 See Mike LLC can cut through the red tape and work to get you the compensation you deserve.
