A statute of limitations is the maximum amount of time from the time that an incident occurred to the time that you must take legal action on it. In the case of wrongful deaths, that means the maximum amount of time that you have to take legal action from the date that the individual died. In Illinois, the statute of limitations for wrongful death lawsuits is generally two years. So, the general rule is that you must begin the legal process two years from the exact day that your loved one has died. If you are unable to do this, your case will not be accepted and you cannot take any legal action on it ever again.

We know that beginning the process may seem like a daunting task, however, in order to get peace of mind, justice, and monetary damages for the devastation that you have endured, you should begin speaking with an attorney before the two year mark.
