Helicopter accidents are some of the most dangerous aviation accidents. Their small size makes them more easily manipulated by the wind and thus can be more easily taken down. If you or a loved one was injured in a helicopter accident, contact us for a free consultation to see if you may be entitled to compensation.

What kinds of accidents and injuries can occur?

Helicopter accidents can occur from a few factors. Sometimes, helicopters may crash due to defects in the aircraft. Perhaps an important control in the cockpit is defective or malfunctioning and causes the pilot to lose control and crash. Also, the helicopter’s condition must be regularly inspected and maintained to ensure that it is in proper working order. Without adequate repairs or inspections, there may be a flaw in the aircraft that goes undetected.

A crash can also be the product in flaws in communication. If the helicopter is unable to reach the air controllers, they may find themselves in a deadly situation. Lastly, pilot error is a large factor that can lead to a crash. A pilot may miscalculate the speed, protocol for certain altitudes, or use the wrong controls that can bring the helicopter down. Almost any helicopter crash can end in death or severe injuries such as broken bones, traumatic brain injury, spinal cord injury, disfigurement, burns, internal organ injuries, and more.

Who is liable?

Negligence is the basis of these types of accident lawsuits. Negligence occurs when one party breaches the duty of care that they owe to others on the road and injuries directly result from the accident. If a helicopter accident is due to a defect or failure to conduct adequate inspections, the manufacturer of the helicopter and/or its parts can be held liable under product liability laws for releasing a dangerous product to the public. If the accident is due to communication problems due to the machine itself, the machine’s manufacturer can be found liable. If it is due to the air traffic controllers not giving accurate feedback, they can be held liable. If the accident is due to pilot error, the pilot can be held liable.
