Exercise-related accidents are very easy to occur when you think of its premise: many people in a large, crowded room handling heavy weights and working their bodies in different ways. When they fail to keep them safe and you suffer an injury on a gym’s property, premises liability laws allow you the right to sue the property owner for your injury and losses.
There are an infinite amount of possible exercise-related injuries. One could drop a dumbbell or a heavy weighted plate on their foot, trip on the treadmills, pull a muscle stretching, a machine could malfunction, and the list goes on. Depending on the accident, injuries can range, but can be extremely severe. For instance, dropping a very heavy weight on your foot can cause irreparable damage and complications, possibly resulting in you having to amputate part of your leg. Death can be possible in some scenarios as well. There may also be sanitation issues, slip-and-fall accidents, technical spatial issues, and more, all resulting in injury.
You can sue the gym’s owner for the injuries that you have sustained if it can be found that they breached their duty of ensuring safety through reasonable measures for their guests which caused your injury. However, some gyms have members sign a waiver which attempts to mitigate any liability on their end. It is possible that these can be overcome with the help of an attorney so that you can still be compensated. Or, if one of the machines at the gym malfunctions, such as a leg press machine or an elliptical, you have the option to sue the manufacturers of those machines since it was improperly built to put people in danger, in the first place.
