In the days following a truck accident you will be contacted by insurance adjusters looking to get an official statement from you. This may seem like an easy task, especially when you’ve got nothing to hide and weren’t at fault. However, before giving a statement to any insurance company, you should remember a few important things.

You Do Not Have to Give a Statement Immediately

The time following an accident can be hectic. You may be injured, in the hospital, dealing with numerous phone calls, or just trying to get your life back to normal. When the insurance company calls, you are allowed to decline making any statements until you have had time to process what happened, especially when dealing with the other driver’s insurance company.

When you receive this call, schedule an alternate time to give your statement.

Contact a Lawyer

Give a statement to the insurance company is very important. Experienced insurance adjusters know how to phrase questions to catch you off guard, push for answers, play like they are your buddy, and trick you into agreeing to something that may not be completely true. It is their job to avoid paying you or paying you as little as possible and they will do it in any way they can.

An experienced car accident attorney is your best bet in preparing a statement for the insurance company. 844 See Mike will review the evidence from your claim and help you prepare an official statement before your follow-up phone call with the insurance company.

Never Give More Information Than Necessary

When you speak with any insurance adjuster, never give them more information than they’ve asked for. Keep your answers honest, stick to the facts, and answer all questions you are asked, but refrain from volunteering any additional information until asked.

844 See Mike will advise you on what types of questions you may be asked and the types of answers you should, or should not give, to ensure you receive all that you are entitled to.

The types of questions you are most likely to be asked by an insurance adjuster following a truck accident include:

  • What is your full name?
  • Are you aware this call is being recorded?
  • What is the year, make, and model of the car you were driving?
  • What was the date and time of your accident?
  • How did the accident happen?
  • Was weather an issue in the accident?
  • Did the airbag deploy?
  • Were you wearing a seatbelt?
  • Were you on your phone?
  • Were you under the influence of drugs, alcohol, or medications?
  • Did the police respond?
  • Were you tailgating? Do you ever tailgate?
  • Did you fly forward, backward, or sideways?
  • Do you have any lacerations?
  • Did you have any preexisting conditions that could have been aggravated in this accident?
  • What did you see and hear during the accident?
  • Were there any witness and do you have contact information for them?
  • Does the car need repaired, and do you have estimates?
  • Do you have all paperwork regarding this incident?

Remember, these are just a sampling of the questions you may be asked. These questions could be reworded, and your answers could be misconstrued and used against you. Always consider speaking with a lawyer before answering any insurance adjuster questions.

Ask for a Copy of the Transcript

When you finally give your official statement, it will be recorded. Before the questioning begins, inform the adjuster that you would like a transcript of your statement. If they should claim there will be no written transcript made, ask for a copy of the recording. You have a right to this transcript.
Giving an official statement can be nerve wracking and if you are nervous, you may make mistakes that could affect your claim. Even if you were not at fault, the insurance company can take your statement and use it against you, reducing your payout or causing your claim to be dismissed completely.
