What Determines Failure to Supervise?
Failure to supervise occurs when an adult fails to exercise their duty of care when monitoring children, and may include school employees, family, community leaders, friends, and stepparents. When an adult you trusted to care for your child fails in their duty, the injuries can be serious, and sometimes fatal.
If an adult or entity, such as a school or daycare, takes responsibility for the care of your child, you may be able to hold the responsible party liable for the damages and injuries they caused. Some of the most common examples of failure to supervise include:
- Improper supervision at school, daycare, church, or community events;
- Overlooking harassment, bullying, or sexual harassment;
- Overlooking physical and sexual abuse;
- Improperly supervised school events, parties, field trips, or gatherings.
Proving Failure to Supervise
Failure to supervise cases are similar to other negligence claims. To prove failure to supervise, a plaintiff must prove four elements:
- The existence of a legal duty to the plaintiff;
- The breach of this legal duty by the defendant;
- The plaintiff suffered compensable injuries;
- The injuries suffered by the plaintiff were caused by the breach of duty by the defendant.
An adult that entrusted with supervising children owes them a duty to provide the proper amount of supervision dependent on their age and needs. The courts will examine if the responsible adult acted in a reasonable manner for the situation and circumstances to determine if they were actually negligent in their duties, and if their behavior caused actual injuries, either physically or mentally.
If your child suffered an injury due to a failure to supervise, they may be eligible for compensation for their damages. Contact the experienced personal injury lawyers at 844 See Mike for a free consultation to discuss your case and determine what your child may be entitled to.
