Dump trucks are extremely large vehicles that transport loose materials like sand, gravel, or coal for construction. They can hold up to 26 tons and use a tilting body to dump their load at its site. This extremely heavy load can pose many risks to its drivers and surrounding people and objects. If you or a loved one was injured in a dump truck accident, contact us for a free consultation to see if you may be entitled to compensation.

What kinds of accidents and injuries can occur?

Dump truck accidents can be pedestrian or vehicle collisions due to negligence. Because of the height and weight of dump trucks, the truck or its driver are infrequently injured under normal circumstances. However, the other vehicle can get destroyed and the accident can be fatal for the driver. It would almost certainly be fatal for a pedestrian accident being hit by 26 tons. Another type of accident is an inexperienced driver. Dump trucks require special driving methods since the center of gravity is imbalanced and the load of the truck is so heavy in the back. When drivers fail to abide by these specific methods, they can cause the truck to tip over and cause a lot of damage.

Dump trucks can also have defects in the truck itself, such as sudden stops from overly sensitive brakes which can cause the truck to tip over. The dump truck must be loaded so that the truck is balanced in weight, also. Failure to do so will cause the truck’s tires to pop or even the load to be dumped or thrown over the body of the truck. This can cause many injuries from a load or part of the truck tipping on you from broken bones or bruising to death.

Who is liable?

Negligence is the basis of these types of accident lawsuits. Negligence occurs when one party breaches the duty of care that they owe to others on the road and injuries directly result from the accident. When an accident is due to driver inexperience with driving this type of heavy vehicle, the driver can be liable for their recklessness. But also, the company of the dump truck can be sued for negligent hiring, since hiring an inexperienced driver poses a danger to everyone around them. In a dump truck and vehicle or pedestrian accident, it would be best to hire an experienced attorney to investigate the accident and find who was negligent by not obeying the rules of the road. When the accident is due to truck defects, the manufacturer of the truck can be sued due to negligently releasing a product that is dangerous for public use. When an accident results from the truck’s body is not loaded properly or imbalanced, then the company or workers of the dump truck can be found liable for negligently using the truck.
