Dog owners are liable when their dogs bite or attack another individual under the Illinois Animal Control Act (510 ILC S5). According to Section 16: “Animal attacks or injuries: If a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby.” Here are Chicago’s municipal regulations for animal care and control under Title 7 (Health and Safety) of the Municipal Code of Chicago, Chapters 7-12:

  • Restraint – Dogs must be properly confined within the owner’s property, whether by building or secured fence;
  • Liability – If a dog attacks and/or injures another person due to lack of restraint, the dog’s owner will be legally liable and may pay fines and/or full restitution to the victim for the damages;
  • Dangerous dogs – A dog which is deemed dangerous by the executive director may need liability insurance, muzzling, sterilization, obedience training, or a combination of these.
