Pool gates are meant to prevent any accidents in a pool once it is closed and there is no staff available to ensure the safety of others. If someone is able to get through the pool gates due to a defect or not following Illinois law’s protocol for their construction, the property owner of the pool may be found liable for negligence in accordance with premises liability laws.

Illinois law mandates that pool gates must be designed at least four feet tall, no more than four inches above the ground, and so that they cannot be climbed. This is to ensure that people are unable to get in the pool when proper supervision is not present. When the pool gate is defective, this can be seen as negligence, since they are not acting in the interest of the safety of others. People would be easily able to get past the gate and suffer from a slip and fall, a brain injury from diving, or even drowning. Failure to maintain a proper and safe pool gate can result in injury to others. We will help you in a free consultation to discuss the details of the incident and evaluate if you have a viable case against the pool’s owner for negligence.
