Condominiums are a place to call home for many people since they are typically bought whereas apartments are rented. You call your condo your home for at least a few years. Thus, you should have the basic expectation that it is safe for you and perhaps your family to live in. But many condominium accidents happen on the premises every year, and some with serious injury. A condominium accident can involve a number of injuries and incidents since it accommodates all basic needs of life; there are several ways that things can go wrong. Fundamentally, condominiums owe all of its residents and visitors a duty of care to keep them safe. It could be a lack of a “wet floor” sign in the lobby, or lack of salt surrounding the property of the building when it is icy outside, both resulting in a slip and fall. Or perhaps there is a gas leak in your unit causing toxic or smelly fumes to be released, or smoke fumes from a fire code violation. Also, there could be faulty furniture which can cause injuries, for instance if you were to sit in a broken chair and break your pelvis.
There are a couple options of the parties to sue in a condominium accident. Condominiums as a whole are typically owned by a homeowners association which you can sue if you and your attorney find that to be the right option for you. If it was a piece of equipment or something of the like, you could possibly sue the product manufacturer and/or the companies that approved its safety; for instance if you got a severe electrical shock from an open outlet, you may sue the laboratory that approved the electric current and outlet’s safety. If you are renting your unit from a landlord and the injury came from within your unit, you can sue the landlord.
