Causation in Car Accidents
When an individual is injured in a car accident and seeks to pursue an injury claim against the responsible driver’s insurance company, his/her attorney must prove three things. First, that the accident was the fault of the other driver. Second, it must be proven that the victim was injured; this may seem obvious, but insurance companies will often hire “independent medical consultants” to evaluate an accident victim with the intent to prove that his/her injuries were exaggerated.
The third point to be proven is that the victim’s injuries were caused directly by the negligence/recklessness of the other driver. It is entirely legally necessary to draw a line of causation between the driver’s recklessness and the victim’s injuries. So how, then, is causation determined? It must clearly be proven that actions of the at-fault driver were a necessary cause of the victim’s injuries, implying that the victim would not have been injured had the other driver acted differently.
In some situations, an insurance company’s lawyer will agree that the at-fault driver’s negligence caused the accident, but that the accident did not create the victim’s injuries and/or medical conditions; they will instead reach for other causes, such as the victim’s medical history. This is a common tactic of defense-designated “independent” doctors, but experienced, knowledgeable attorneys cannot and will not be fooled by unfounded attempts to win cases and will stop at nothing to receive just compensation for their clients.
