The purpose of a balcony railing is to protect the visitors of their property while they safely enjoy being outside. It is the responsibility of the owners of that property to ensure that it is safe to use and there is no risk of injury when using the balcony. However, there are numerous incidents of faulty balcony railings causing injury to its users. What types of accidents occur from balcony railings?

Each year, many apartment complex balcony railings of individual apartment units are found to not have the structural integrity that they are meant to have to keep people safe. This can include accidents of falling off of the side of the railing, which happens when the railing was not built tall enough to the standard that it should be. Or, the railing could have partially or fully broken as someone leans on it, in which case it was not built properly, screws holding it together were loose, or the actual structural integrity of the sides was simply too weak. Property owners may also carelessly fail to notify residents of the weight limits that their balconies can withstand. This is information that should certainly be disclosed to tenants so that they are aware of their limits. Failure to do so can result in the balcony’s structural integrity being compromised and anyone on the balcony falling from a height. Also, property owners should generally be conducting inspections on these balconies periodically to confirm that they are safe to use. If they fail to do so, they may neglect to conduct these also and put all tenants at risk.

Who is responsible for my injuries?

A balcony railing accident can have very severe injuries depending on the circumstances. Sometimes, it may just be some bruising, cuts and scrapes. Other times when it is from a larger height, there can be bone fractures, broken bones, concussions, and even partial paralysis. You deserve to be compensated for what they caused to happen to you. You would have to prove that it was the defendant’s responsibility to uphold a duty of care to you while on their property. They fail when the balcony railing proved to be too weak to do so.
