People typically go to amusement parks on a fun date or a family outing looking for a good time spent on roller coasters, indulging in some concession stand food, or seeing shows at the park. Thousands of people pass through the park on a daily basis looking for some adrenaline and fun. With all of these people, the parks have many safety and security precautions that they must take care of, especially when you consider the risk involved in amusement park rides and rollercoasters. If you or a loved one has been injured in an amusement park accident, you may consider speaking to one of our attorneys regarding a premises liability lawsuit.

What types of injuries occur at amusement parks?

Amusement parks, while fun and adventurous, can prove to be dangerous and hazardous. We have all heard of accidents occurring to park-goers, mostly from those that have suffered major injury or death on roller coasters. There are a number of different types of injuries that can occur at these parks. People can get severely injured or killed on defective roller coasters or rides. People can be thrown off of the ride from not being properly secured in, they can suffer pinching injuries based on how they were secured in, whiplash, and unconsciousness. There should be a particularly great duty of care in the production of roller coasters and rides, given their inherent risk. In this case, you may sue the manufacturer of the roller coaster or the amusement park.

Another type of injury could be a food-related illness from the concessions stands situated around the park. The food may have been unsanitary or given you food poisoning. You may suffer for days or weeks being sick. In this case you may sue the amusement park or the owner of the concessions stand, dependent on the circumstances surrounding your case.

Who is liable?

First and foremost, to prove negligence in a premises liability lawsuit, you should be classified as an “invitee,” or someone that was admitted to the park and in a lawful area at the time of the accident. you should be able to prove that the park owes you, one of its patrons a duty of care, that duty was breached, their negligence in doing so directly caused your injury, and that you suffered actual damages. Your attorney will assist you in making a successful case by proving negligence by going through the evidence and events of the day.

If you were an undiscovered trespasser at the time of the accident, then you are not protected by premises liability laws since no duty is owed to that type of entrant. That is, as long as the amusement park did not have willful intent to hurt you on any part of the property.

As mentioned above, it depends on the circumstances of the case, since there are so many components, parties, and businesses involved in the making and operation of an amusement park. After you speak with an attorney, we will make this as seamless of a process for you so that you can get the justice and compensation that you deserve.
