Skid-steer loaders are tractor-like pieces of machinery that are used to carry large loads of countless types of materials. They have a bucket on the front end to pick up, transport, and move materials. Although they come in handy for large projects on farms or in construction, the very nature of these machines makes them very risky for many people to use. If you or a loved one has been in a skid-steer loader accident, contact us for a free consultation to see if you may be entitled to compensation.

What kind of accidents or injuries can result?

Skid-steer loader accidents are often due to defects in the machinery itself. A defect in the machinery could cause the machine to turn or brake suddenly and/or incorrectly, it can cause the bucket to move improperly, it can spark or even catch fire, and more. In any case, it can cause serious injury to those surrounding the machine and the one operating it. Any accident from this machine can cause whiplash, concussions, traumatic brain injury, spinal cord injury, neck and back injury, broken bones, and more.

Also, skid-steer loaders can crush its owner if they are cleaning or surrounding it, or if they fall from the seat within the machine. Unfortunately, the skid-steer loader can continue to move and roll over or crush the person that is in the way. This results in fatal injuries most of the time. The load of the bucket may also be imbalanced or improperly loaded, which can cause a sudden accident that hurts the operator through a tip-over or rollover accident. The load itself may even fall on the person. These are often fatal or almost fatal injuries, as well.

Who is liable?

These cases are based on negligence, which is determined by finding if the other party owed you a duty of care, breached that duty of care, your injuries directly resulted from their actions, and you suffered actual damages and losses.

If a skid-steer loader accident was due to a defect, the manufacturer of the machine can be liable for the injuries and damages. This is due to product liability laws that are meant to protect people from products that are negligently made and pose a risk to those that use it or are around it. The same applies to accidents where you believe that the machine malfunctioned and rolled over or tipped over and hurt a person. If the accident was due to an imbalanced load, then the worker that loaded the machine may be liable for the damages that resulted from their negligence in working.
