Overcrowding
All pool owners must exercise a reasonable duty of care in the property that they manage to ensure the safety of their lawful entrants. One of these duties is supervising the amount of people in a pool so that it does not overcrowd. If you or a loved one has been in a swimming pool accident due to overcrowding, you may consider filing a premises liability lawsuit for justice and compensation.
All pools have a predetermined limit on the capacity that should be permitted on the property. This is to keep guests safe and out of harm’s way. An overcrowded pool means that lifeguards have more difficulty keeping an eye on each person in the pool. Even if they are unable to see, a parent trying to watch their child may have difficulties trying to spot them as a second resort. This means that accidents, such as drowning, are more likely to occur when it is overcrowded. It is more difficult to see someone struggling in a crowd of 50 people as opposed to a crowd of 5 people.
If the pool owner does not make the efforts and enforce the rules to control its capacity, people could be at serious risk of drowning, and the owner may be found liable for negligence under premises liability laws.
