Can a Landlord Be Responsible If My Dog Bites Someone?

Generally, landlords in Illinois would not be held responsible if a tenant’s dog should bite someone. Instead, the liability would fall onto the dog’s owner under the Illinois Dog Bite Statute 510 ILCS 5/16 which states:

If a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby.

To prove that the owner is liable for their dog attack, the victim would need to show that the attack met these three parameters:

  • The dog or other animal attempted to attack, attacked, or injured the victim.
  • The victim had the legal right to be in the place where the attack occurred.
  • The dog or other animal was not in any way provoked into attacking.

However, there are cases where a landlord could potentially be held liable for a tenant’s dog biting another person. These cases would include:

  • The landlord knew the dog had a history of attacking, biting, or being aggressive.
  • The landlord could have had the dog legally removed from the property.
  • The landlord had rules in place that required the dog to be leashed or restricted to certain areas of the rental property.
  • The landlord cares for the dog while the owner is at work, thus becoming a de facto owner.
