Driver Error Causing Truck Hitting Train Accidents

Trucking companies are responsible for training their drivers and ensuring they know how to safely approach the over 250,000 railroad crossings in the U.S. Truck drivers, who may be inexperienced, working long hours and are often fatigued or pressured into delivering their freight as quickly as possible, often commit driving errors they otherwise wouldn’t normally do, such as attempting to illegally cross at a railroad crossing instead of waiting for a train to pass. Federal Motor Carrier Safety Administration Regulations

The Federal Motor Carrier Safety Administration (FMCSA) regulates the trucking industry and has recognized that truck and train accidents are a real concern. The FMCSA has issued regulations that prohibit commercial trucks from entering railroad crossings if there is not enough clearance for the truck to pass through without stopping.

If there is not proper opportunity for a truck to pass safely, the FMCSA requires the truck driver to be alerted of this issue and an alternate route found, a smaller vehicle is used to transport the freight in that area, or the train company is alerted that a truck will be crossing and the time they will be doing so.

If these regulations are not followed, the FMCSA will issue penalties against the trucking company. These can include:

  • $2,750 fine for the driver
  • $11,000 fine for the trucking company
  • 60-day disqualification from driving for a first offense
  • 120-day disqualification from driving for a second offense in a 3-year period
  • 1-year disqualification from driving for a third offense in a 3-year period

If an accident occurs that involves a commercial truck and train, the accident will be investigated by both the National Transportation Safety Board and the Federal Railroad Administration. The majority of the time, the accident is due to driver error and often these accidents are fatal.
